4. RISKS AND CONSEQUENCES.

By participating, you accept that losing the Game may cause technical issues, including the need for system restoration or software reinstallation.

You agree to indemnify and hold harmless The Open Gamer LLC, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, expenses or fees, arising out of or relating to your use of the Game, your applicable usage content and in case of your violation of these Terms and Conditions or your violation of any rights of another person or entity. This includes, but is not limited to, claims of copyright infringement, defamation, violation of privacy, or any other claims arising from content you create or actions you take while using the Game.

6. LIMITATION OF LIABILITY.

To the fullest extent permitted by applicable law, in no event shall The Open Gamer LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your use of the Game, even if we have been advised of the possibility of such damages. This includes, but is not limited to:

➖ Hardware, software, or data damage;
➖ Loss of personal, financial, or business data;
➖ Costs for data recovery, repair, or reinstallation.

You are responsible for ensuring adequate backups of your data. Our total liability to you for any claim arising out of or relating to these Terms and Conditions or the Game shall not exceed the amount you paid for the Game.

7. NO WARRANTY.

The Game is provided "As Is" and "As Available" without any warranty, express or implied, regarding its functionality, performance, or outcomes.

8. LEGAL JURISDICTION.

You agree to be governed by and construed in accordance with the laws of the jurisdiction in which the developers operate, without regard to its conflict of law principles. Any legal disputes shall be resolved in that jurisdiction's courts.

10. TERMINATION.

We reserve the right to terminate your license to use the Game at any time, with or without cause. You may terminate these Terms and Conditions by discontinuing all use of the Game and uninstalling it from your device. Upon termination, all usage rights granted to you will immediately cease.
