By downloading, installing or using FLUENT (the "App"), you agree to these Terms and Conditions. If you disagree, DO NOT download, install or use the App at all.

1. ACKNOWLEDGMENT.

By downloading, installing or using the App, you confirm that you have read, understood, and agree to these Terms and Conditions. Otherwise, discontinue use immediately.

2. USAGE RIGHTS.

The App can be installed for both commercial and personal use, but only on a single Windows-based computer or device owned or controlled by you. Under no circumstances shall you:

➖ Copy, modify, or distribute the App or any portion thereof;
➖ Reverse engineer, decompile, or disassemble the App;
➖ Remove or alter any copyright or proprietary information;
➖ Use the App for any illegal or unauthorized purpose;
➖ Rent, lease, sublicense or distribute the App in any manner.

The App and all its components, including but not limited to code, design, text, graphics, logos, and trademarks, are protected by copyright, trademark, and other intellectual property laws. These Terms and Conditions do not grant you any ownership rights in the App.

3. THIRD-PARTY LIBRARIES.

The App may utilize third-party libraries such as Vosk and Win32 to provide certain functionalities. We are not responsible for the performance, availability, or security of third-party libraries. Please review their respective terms of service and privacy policies for more information.

4. HOTKEYS CONFIGURATIONS.

You are solely responsible for any consequences resulting from your use of hotkeys within the App. We are not liable for any damages or losses arising from the activation of hotkeys in unintended applications or situations. Ensure you understand how the hotkeys function and exercise caution when using them. Consider changing your hotkeys when potential conflicts may arise.

5. TRANSCRIPTION ACCURACY.

Please keep in mind that you are solely responsible for verifying the accuracy of any transcriptions generated by the App. The accuracy of transcriptions may be affected by your accent, background noise, speaking speed and many other factors. Therefore, we cannot guarantee the accuracy of the transcriptions provided by the App. Make sure to review transcribed text before using it.

6. INDEMNIFICATION.

You agree to indemnify and hold harmless The Open Gamer LLC, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, expenses or fees, arising out of or relating to your use of the App, your applicable usage content and in case of your violation of these Terms and Conditions or your violation of any rights of another person or entity. This includes, but is not limited to, claims of copyright infringement, defamation, violation of privacy, or any other claims arising from content you create or actions you take while using the App.

7. LIMITATION OF LIABILITY.

To the fullest extent permitted by applicable law, in no event shall The Open Gamer LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these terms or the app shall not exceed the amount you paid for the App.

8. NO WARRANTY.

The App is provided "As Is" and "As Available" without any warranty, express or implied, regarding its functionality, performance, or outcomes.

9. LEGAL JURISDICTION.

You agree to be governed by and construed in accordance with the laws of the jurisdiction in which the developers operate, without regard to its conflict of law principles. Any legal disputes shall be resolved in that jurisdiction's courts.

10. FUTURE CHANGES.

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated these Terms and Conditions here. Your continued use of the App after the posting of changes constitutes your acceptance of such changes.

11. TERMINATION.

We reserve the right to terminate your license to use the App at any time, with or without cause. You may terminate these Terms and Conditions by discontinuing all use of the App and uninstalling it from your device. Upon termination, all usage rights granted to you will immediately cease.
